Terms of Use

1. About these terms

GN Assist (“GN Assist”, “we”, “us”) provides clinical decision-support tools at www.gnassist.com (the “Site”). These Terms of Use are a binding agreement between you and GN Assist. By creating an account or using the Site, you agree to them. If you do not agree, do not use the Site.

2. Who may use GN Assist

The Site is intended only for licensed physicians, nurses and other qualified healthcare professionals, and for trainees working under their supervision. It is not intended for patients or the general public. By using the Site you confirm that you are such a professional.

3. Decision support, not medical advice

The tools organise published guidelines, scoring systems and calculations to support, not replace, your own clinical judgment. They do not provide medical advice, diagnosis or treatment, and they do not take into account every factor relevant to an individual patient.

4. Verify before you act

Before using any result in patient care you must independently verify it, including:

• calculations, scores and units of measurement;
• drug choices, doses, dose adjustments and schedules, against the current product information (monograph or label) and your local formulary;
• recommendations, against the current version of the cited guidelines and your institution's protocols.

5. Your professional responsibility

You remain solely responsible for all decisions about the care of your patients, including any decision to rely on, modify or disregard information from the Site. You use the Site at your own risk and accept all risks arising from its use. You are responsible for complying with the laws, regulations and professional standards that apply to your practice, and for maintaining your own professional liability insurance.

6. Accuracy and currency

The content may contain errors or omissions, and guidelines, evidence and drug information change over time. We make no promise that any content is complete, correct or up to date, and we have no obligation to update it.

7. Not a medical device

GN Assist has not been evaluated, cleared or approved as a medical device by Health Canada, the U.S. Food and Drug Administration, China's National Medical Products Administration or any other regulator. It must not be used as the sole basis for a diagnosis or treatment decision.

8. No doctor–patient relationship

Using the Site does not create a doctor–patient or any other professional relationship between GN Assist and you or your patients.

9. Not for emergencies

Do not rely on the Site in time-critical or emergency situations. Follow your institution's emergency procedures.

10. Translations

French and Chinese versions of the Site are provided for convenience. Translated clinical content may not have been reviewed by a clinician fluent in that language. If a translation differs from the English text, the English version prevails.

11. Patient information and privacy

The tools are designed to run in your browser: values you enter into a tool are not saved, stored or transmitted to us. Your account email, name and institution are used only to run your account. You are responsible for complying with the privacy and confidentiality rules that apply to you, including when you print, copy or share results.

12. Your account

Keep your password confidential and do not share your account. You are responsible for all use of your account. We may suspend or close accounts at any time, for any reason.

13. Free service and availability

The Site is provided free of charge. It may be interrupted, contain defects or be changed or withdrawn, in whole or in part, at any time and without notice. We have no obligation to maintain, support or continue it.

14. No warranty

To the fullest extent permitted by law, the Site and all content are provided “as is” and “as available”, without warranties or conditions of any kind, express or implied, including any warranty of accuracy, completeness, merchantability, fitness for a particular purpose or non-infringement. We do not warrant that any calculation, score, dose or recommendation is correct or suitable for any patient, or that the Site will be uninterrupted, secure or free of errors.

15. Limitation of liability

In this section and section 16, “GN Assist Parties” means GN Assist and its owners, operators, developers, clinical authors, reviewers, translators and other contributors.

To the fullest extent permitted by law, the GN Assist Parties are not liable to you or to anyone else, including your patients, for any loss, injury, death or damage of any kind, whether direct, indirect, incidental, special, consequential or exemplary, arising from or related to the Site, its content, your use of or inability to use it, or any clinical decision made with it. This applies whatever the legal basis of the claim (contract, tort including negligence, statute or otherwise), even if we were told the loss was possible.

Where liability cannot be excluded by law, the total liability of all GN Assist Parties together is limited to the amount you paid to use the Site in the twelve months before the claim, which is nothing, or, if a minimum amount is required by law, to that minimum. Nothing in these terms excludes liability that cannot be excluded under the law that applies.

16. Indemnity

You agree to indemnify and hold harmless the GN Assist Parties from any claim, demand, loss, liability, cost or expense (including reasonable legal fees) brought by a patient or any third party, or otherwise arising from your use of the Site, your clinical decisions, your breach of these terms or your violation of any law or professional standard.

17. Third-party content and links

Guidelines, trials and scoring systems referred to on the Site belong to their respective authors and publishers. Their citation does not imply their endorsement of GN Assist. We are not responsible for third-party content or websites linked from the Site.

18. Changes to these terms

We may update these terms. The date at the top shows the latest version. Continuing to use the Site after a change means you accept the updated terms.

19. General

If any part of these terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the rest of the terms remain in effect. Our failure to enforce any provision is not a waiver of it. These terms are the entire agreement between you and GN Assist about the Site. Sections 3 to 5 and 14 to 16, and this section, continue to apply after your use of the Site or your account ends.
